Terms and Conditions for Promotional Text Messages
1. Consent to Receive Promotional Text Messages
By providing your mobile phone number and selecting the opt-in checkbox, you expressly consent to receiving recurring promotional and marketing text messages from COYOTE CANYON WINERY ("Company") at the mobile number you have provided. These messages may be sent using an automatic telephone dialing system ("ATDS") or artificial or prerecorded voice technology as defined under the Telephone Consumer Protection Act ("TCPA"), 47 U.S.C. § 227, and related Federal Communications Commission ("FCC") regulations.
2. Nature of Consent

If you have consented to multiple categories of text messages, Company may seek clarification regarding which categories you wish to opt out from, but will cease sending all messages requiring consent until such clarification is received.

Company will not sell, rent, or share your mobile number with third parties for their independent marketing purposes without your express consent.
7. Changes to Terms and Conditions
Company reserves the right to modify these Terms and Conditions at any time. Any material changes will be communicated to you via text message with a link to the updated Terms and Conditions.
Your continued receipt of Company's text messages after receiving notice of changes constitutes your acceptance of the modified Terms and Conditions.
8. Limitations of Liability
Company makes no warranties or representations regarding the text message service.
In no event shall Company be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the text message service, whether based on contract, tort, strict liability, or any other legal theory.
9. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with federal law, including the TCPA and FCC regulations, and the laws of the United States, without giving effect to any principles of conflicts of law. Any dispute arising from these Terms and Conditions shall be resolved in the appropriate federal court with jurisdiction.
